1. Agreement to Terms
By accessing or using Study Shesh (“the Service”), operated by Study Shesh (“we”, “us”, “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the Service.
2. Description of Service
Study Shesh is an online study platform designed to help students prepare for VCE English. The Service provides practice questions, flashcards, AI essay feedback with Professional and Spicy modes, study materials, progress tracking, and related educational tools.
Important: Study Shesh is an independent educational resource. We are not affiliated with, endorsed by, or connected to VCAA (Victorian Curriculum and Assessment Authority) or any regulatory body. The content provided is for study purposes only and should not be considered official exam material.
Some features of the Service involve the submission, storage, analysis, and display of user-generated content, including essays, prompts, files, AI feedback, and progress data. We may also introduce classroom, teacher-linked, or school-linked features that allow authorised teachers or school representatives to view student work, feedback, and related progress information within the permissions of those features.
3. User Accounts
To access the Service, you must create an account using a valid email address. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You must notify us immediately of any unauthorised use.
If the Service is used through a school, teacher, parent, or another authorised educational arrangement, additional permissions, notices, or school-specific terms may apply.
4. User Content and Essay Submissions
You retain ownership of the original content you submit to the Service, including essays, paragraph responses, prompts, uploaded documents, and related materials (“User Content”). However, by submitting User Content through the Service, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, adapt, analyse, and display that User Content as reasonably necessary to operate, improve, secure, and support the Service.
This licence includes using User Content to provide AI-generated feedback, save drafts, generate structured writing insights, detect misuse, support product analytics, and enable future teacher-linked or classroom features where those features are part of the Service.
You must only submit content that you have the right to submit and share. You must not upload material that unlawfully infringes another person's rights, contains malicious code, or includes personal information about other people that you do not have permission to provide.
5. Purchases and Billing
Certain features of the Service require a one-time paid purchase. Payments are processed via Stripe and are tied to your VCE English exam date. Key billing terms:
- Access auto-expires on your selected exam date.
- The total price depends on how far in advance you purchase (early bird pricing).
- This is a one-time payment; there are no recurring charges.
- Refunds are handled in accordance with Australian Consumer Law.
Prices are listed in Australian Dollars (AUD). We reserve the right to change pricing with 30 days' notice for future purchases.
6. Acceptable Use
You agree not to:
- Share your account credentials with others.
- Copy, reproduce, distribute, or create derivative works from any content on the Service.
- Use automated tools, bots, or scrapers to access the Service.
- Attempt to circumvent payment requirements or access controls.
- Use the Service for any unlawful purpose or in violation of any applicable law.
- Share exam questions or content from the Service publicly or with non-subscribers.
- Upload content you do not have the right to use or share.
- Misuse any classroom, teacher, or school-facing feature to access work you are not authorised to see.
7. Teacher and Classroom Features
If we make teacher, class, or school-linked features available, access to student work, feedback, analytics, or progress information will be governed by the permissions, roles, and workflows built into those features. We may limit, suspend, or revoke access where we reasonably believe access is unauthorised, inappropriate, unlawful, or inconsistent with the intended educational relationship.
We may also maintain records of class membership, submissions, viewing activity, or related actions where reasonably necessary to operate these features, support schools, investigate issues, or protect users and the Service.
8. Intellectual Property
All content on the Service, including but not limited to practice questions, flashcards, study materials, software, design, and trademarks, is owned by Study Shesh or its licensors and is protected by Australian and international intellectual property laws. Your purchase grants you a limited, non-exclusive, non-transferable licence to access the content for personal educational use only.
9. AI Features and Educational Use
AI-generated feedback is automated and may be incorrect, incomplete, inconsistent, or unsuitable for a particular student, classroom, school policy, or assessment context. You are responsible for reviewing AI outputs critically and deciding how to use them.
If teacher or classroom features are introduced, analytics and summaries derived from student work are intended as educational support tools only and should not be treated as the sole basis for academic, disciplinary, wellbeing, or administrative decisions.
10. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not guarantee that:
- The content is free from errors or omissions.
- Use of the Service will result in passing VCE English or any other examination.
- The Service will be uninterrupted, secure, or error-free.
- The content reflects the most current regulations, guidelines, or exam content.
You acknowledge that exam preparation outcomes depend on many factors beyond our control and that the Service is a supplementary study tool, not a guarantee of success.
11. Limitation of Liability
To the maximum extent permitted by Australian Consumer Law, our total liability to you for any claims arising from or related to the Service is limited to the amount you have paid us in the 12 months preceding the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages.
12. Termination
We may suspend or terminate your access to the Service at any time if you breach these Terms or engage in conduct that we determine to be harmful to other users or the Service. You may close your account at any time by contacting us.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service and updating the “Last updated” date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by the laws of the State of New South Wales, Australia. Any disputes arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of New South Wales.
